Prenuptial/Postnuptial Agreements
Before marriage, parties to a prenuptial agreement can determine how their assets will be divided in the event of death or divorce. Through the use of such a prenuptial agreement, an interest in a family business can be protected in the event of a subsequent divorce. Further, an individual’s assets (or a portion thereof) can be preserved for, perhaps, children of a prior marriage instead of for the surviving spouse. Postnuptial agreements, too, can be utilized for asset protection even subsequent to a marriage.
